These Terms of Use (“Terms”) constitute a legal agreement between you (“User”) and Cloudize Pty Ltd, trading as Professionalize, which owns and operates this website and its related services.

By accessing, browsing, or using this website or any of its associated services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations.
If you do not agree with these Terms, you must not use this website.

Information contained on this website may include technical inaccuracies or typographical errors and is subject to change without notice. Professionalize may make improvements and/or modifications to products, services, or programs described at any time.

Security and Data Protection

Professionalize’s Security Practices are incorporated into these Terms by reference and may be updated periodically.

Professionalize implements and maintains administrative, physical, and technical safeguards to protect the security, confidentiality, and integrity of User Data.
These safeguards include measures to prevent unauthorized access, use, modification, or disclosure of User Data, except as necessary:

  • to provide the Service and address service or technical issues,
  • as required by law, or
  • as expressly authorized by the User in writing.

Data Processing and GDPR Compliance

Professionalize’s services are hosted using equipment and facilities located primarily in the United States.
Our U.S.-based service providers are Privacy Shield certified or have executed Standard Contractual Clauses approved by the European Commission, ensuring compliance with Article 46 of the General Data Protection Regulation (EU) 2016/679 (“GDPR”).

By agreeing to these Terms, the User grants Professionalize a general authorization under Article 28(2) of the GDPR to engage processors for the purpose of providing the Service.
The list of engaged subprocessors is publicly available on the Subprocessors page. Updates to this list will be communicated in accordance with these Terms.

For GDPR purposes, these Terms constitute the data processing agreement between the User (data subject) and Professionalize (data controller and/or processor).
Professionalize acts as the data processor where Users operate under a metered or hosted plan.

Subject matter and nature of processing:
Professionalize provides online services that require User account creation, involving the collection of personal information such as name, email address, and billing details.
Professionalize uses this information to provide services, process transactions, maintain purchase records, manage support interactions, and send relevant communications.

Duration of processing:
Professionalize retains User Data for the duration of the account relationship. Upon termination, data is retained for up to 7 days to allow account reactivation or data export unless otherwise instructed by the User. Thereafter, data is permanently deleted unless retention is required by applicable law.

Parties’ rights and obligations:
Users retain ownership and control of their data. Professionalize ensures all personnel authorized to process data are bound by confidentiality obligations and comply with Article 32 of the GDPR.
Professionalize agrees to provide necessary documentation and support to demonstrate compliance and enable User audits when reasonably requested.

Unlawful Client Data

Professionalize does not pre-screen or monitor User Data to determine legality or compliance.
However, if any unlawful data or processing is discovered, or if notified by a competent authority, Professionalize reserves the right to:

  • Notify the User of such unlawful data;
  • Deny its publication or remove it from the system;
  • Require the User to bring such data into compliance with applicable laws;
  • Temporarily or permanently restrict access or delete the data.

If credible evidence is provided demonstrating that the data is lawful, Professionalize may, at its discretion, restore access or reinstate the content.

Professionalize also complies with the Digital Millennium Copyright Act (DMCA) and will promptly remove any infringing material upon receipt of a valid takedown notice.

Data Rights and Assistance

As both a controller and processor, Professionalize assists Users in fulfilling their obligations under the GDPR, including data access requests, correction, deletion, and exercising other data subject rights.

Professionalize assumes no responsibility for the accuracy of any information provided and offers no guarantees that reported issues can or will be resolved using materials provided through this website.

Technical Information and Submissions

By submitting information or materials to Professionalize, you grant Professionalize and its affiliates permission to collect and use technical data (excluding confidential data) to improve our products and services or provide personalized support.
No automatic collection of confidential data occurs — all information is shared voluntarily as part of a support interaction.

Professionalize may include links to external websites for convenience. These sites are not under the control of Professionalize, and their inclusion does not imply endorsement.
Professionalize accepts no responsibility for the content, security, or use of third-party websites.

Limitation of Liability

IN NO EVENT SHALL PROFESSIONALIZE OR CLOUDIZE PTY LTD BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, BUSINESS INTERRUPTION, LOSS OF DATA, OR SYSTEM FAILURE, ARISING OUT OF OR RELATING TO THE USE OR INABILITY TO USE THIS WEBSITE OR ANY LINKED WEBSITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
